Terms and Conditions

These terms govern your use of SenseiDesk martial arts management software and services.

1. Agreement to Terms

By accessing and using SenseiDesk ("the Service"), provided by IEMTech ("we," "us," or "our"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

SenseiDesk is a Software-as-a-Service (SaaS) platform designed for martial arts gyms and schools in the Philippines. The Service provides:

  • Student and parent management systems
  • Automated billing and invoicing
  • Attendance tracking and reporting
  • Payment processing integration via Xendit
  • Communication tools for announcements
  • Progress tracking and belt management

3. User Accounts and Responsibilities

3.1 Gym Owner Responsibilities

As a gym owner using SenseiDesk, you are responsible for:

  • Maintaining accurate student and parent information
  • Setting appropriate billing rates and policies
  • Ensuring compliance with local Philippine regulations
  • Handling student/parent disputes regarding billing or services
  • Maintaining the security of your account credentials
  • Training your staff on proper use of the system

3.2 Student and Parent Responsibilities

  • Providing accurate contact and payment information
  • Making timely payments for martial arts services
  • Reporting any billing discrepancies to the gym directly
  • Using parent/student portals responsibly

4. Payment Terms

4.1 SenseiDesk Platform Fees

  • Session-based pricing: ₱12-₱20 per consumed session depending on gym size
  • Monthly student pricing: ₱85 per active student per month
  • Platform fees are billed monthly to gym owners
  • First month is free for new accounts
  • Payment due within 14 days of invoice date

4.2 Student Payment Terms

Student payments for martial arts services are handled between students/parents and gym owners. SenseiDesk facilitates payment processing through Xendit but does not guarantee payment collection. Gym owners are responsible for setting their own payment terms, late fees, and collection policies.

4.3 Payment Processing

Payment processing is provided by Xendit, a third-party payment processor. By using our payment features, you agree to Xendit's terms of service. We do not store sensitive payment information on our servers.

5. Data Privacy and Security

We take data protection seriously and comply with applicable Philippine data privacy laws:

  • Student and parent data is encrypted and stored securely
  • We do not sell or share personal data with third parties
  • Data is used only to provide and improve our services
  • Users have the right to request data deletion upon account closure
  • We implement industry-standard security measures

6. Limitation of Liability

To the maximum extent permitted by Philippine law:

  • SenseiDesk is provided "as is" without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim
  • We are not responsible for payment disputes between gyms and students/parents
  • Service interruptions due to maintenance, technical issues, or force majeure are not our liability

7. Service Level and Availability

While we strive for 99.9% uptime, we do not guarantee uninterrupted service. We may:

  • Perform scheduled maintenance with advance notice
  • Temporarily suspend service for security or technical reasons
  • Modify features or functionality with reasonable notice

8. Acceptable Use Policy

You agree not to:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in the Republic of the Philippines
  • Transmit viruses, malware, or harmful code
  • Attempt to gain unauthorized access to our systems
  • Use the Service to spam or harass students/parents
  • Reverse engineer or attempt to extract source code

9. Termination

Either party may terminate this agreement:

  • With 30 days written notice for any reason
  • Immediately for material breach of these terms
  • Immediately for non-payment after 30-day grace period

Upon termination, you will have 30 days to export your data before it is deleted from our systems.

10. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of the Republic of the Philippines. Any disputes arising from these terms shall be resolved in the courts of Cebu City, Philippines.

11. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated via email and posted on our website at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the new terms.
